Terms of service
1. Who this agreement is with
SiteWarden ("we", "us") is operated by HRSG GROUP PTY LTD (ABN 55 653 992 495), trading as SiteWarden. These terms apply when you create a SiteWarden account or use the service on behalf of your company ("you", "your company").
2. What SiteWarden is
SiteWarden is a web application that lets your workers record taking and returning tools by tapping a tag, gives your office a live register of tool custody, and keeps an electrical test-and-tag (AS/NZS 3760) compliance record. It is provided as a subscription service (SaaS) — nothing is installed on your devices.
3. Accounts and trials
- You need one office account (email + password) to administer your company's register. Workers never need an account — they use physical or printed tags.
- New accounts get a 14-day free trial with no card required. After the trial, continued access to the office dashboard requires an active paid subscription.
- You're responsible for keeping your login secure and for what happens under your account, including actions taken by workers using tags you've issued.
- You must provide accurate information and only create an account for a real company you're authorised to represent.
4. Subscriptions and billing
- Paid plans are billed monthly in advance, in Australian dollars, GST-inclusive, via our payment processor Stripe. We never see or store your card details.
- You can update your card or cancel any time through the billing portal linked from your Subscribe page. Cancelling stops future billing; your office access continues until the end of the paid period, then locks (your workers can still tap tags to take/return tools — that never stops).
- If a payment fails, we'll attempt to collect it again automatically; your office access may be paused until it's resolved.
- Prices may change with reasonable notice for future billing periods.
5. Your data and your workers' data
- You own the data you put into SiteWarden (tools, sites, worker names/emails/phones, movement history).
- You are responsible for having the right to enter your workers' contact details into the system and for telling them it's being collected — see our Privacy Policy for how we handle it.
- We don't sell your data or share it with other customers. See the Privacy Policy for the few third parties (payment processing, email delivery, hosting) that process it on our behalf.
6. Acceptable use
Use SiteWarden only for your own company's tools and workers. Don't attempt to access another company's account or data, interfere with the service, or use it for anything unlawful.
7. Service availability
We aim to keep SiteWarden available and take daily backups, but during this early stage the service is provided "as is" without uptime guarantees. Keep your own copies of anything business-critical (an audit report export is available any time from Compliance).
8. Liability [needs lawyer review — liability caps are jurisdiction-specific]
Placeholder: a standard SaaS limitation-of-liability clause (capping liability at fees paid in the prior 12 months, excluding indirect/consequential loss, subject to Australian Consumer Law guarantees that can't be excluded) belongs here. Do not rely on this section until it has been drafted properly.
9. Ending this agreement
You can stop using SiteWarden and cancel your subscription at any time. We may suspend or end an account for non-payment, breach of these terms, or unlawful use.
10. Changes to these terms
We may update these terms from time to time; continued use after a change means you accept the update. Material changes will be flagged on this page.
11. Governing law
